These terms and conditions (“Terms”) govern the supply of any products by us to you, whether these are goods or digital content, through www.fromfido.com (“Website”) or the FromFido application (“App”) accessible in the United Kingdom. These Terms are legally binding. Please read them carefully before you submit your order to us. These Terms tell you who we are, how we will provide products to you, how you and we may change or end the contract, what to do if there is a problem, and other important information. If you have any questions or require clarification on these Terms, please contact us as outlined in clause 1.2.

If you do not agree to these Terms, you must not order any products from this Website or the App.

  1. ORDERING FROM FROMFIDO

3.1 How to place an order

You need to create an online account to place an order. During this process, you must provide your real name and a valid email address.

You place an order by pressing the Checkout button during the checkout process. By confirming your order, you agree to purchase the selected product subject to these Terms.

After order confirmation, we take payment using your nominated method and send you an order confirmation email.

3.2 Acceptance of your order

Our acceptance of your order will take place when we email you to accept it, which forms a legally binding contract between you and us.

3.3 If we cannot accept your order

If we cannot accept your order for any reason, such as product unavailability or error in price or description, we will inform you and refund any charges.

The Service provides personalized greeting cards generated by artificial intelligence (AI) based on inputs provided by you, the user. While we strive for accuracy and relevance in the content generated by our AI, FromFido does not guarantee that the AI-generated content will always meet your expectations or be free from errors.

  1. CONTENT RULES

You must comply with our content rules, which prohibit offensive, illegal, or infringing material.

  1. CONTENT OWNERSHIP AND LICENSE

By using our service, you understand and agree that all content generated by our AI, including messages and images in greeting cards, are the intellectual property of FromFido or are licensed from third parties for use in our service. While you have the right to use the content as part of the greeting card purchased, you may not reproduce, distribute, or create derivative works from this content without explicit permission from FromFido.

  1. USER GENERATED CONTENT

By submitting, posting, or displaying content on or through FromFido you grant FromFido a worldwide, non-exclusive, royalty-free license (with the right to sublicense) to use, copy, reproduce, process, adapt, modify, publish, transmit, display, and distribute such content in any and all media or distribution methods (now known or later developed). This license includes the right for FromFido to make your content available to other companies, organizations, or individuals who partner with FromFido for the syndication, broadcast, distribution, or publication of content on other media and services, subject to our terms and conditions for such content use. You represent and warrant that you have all the rights, power, and authority necessary to grant the rights granted herein to any content that you submit, and that FromFido’s use of your content will not infringe, misappropriate or violate a third party’s intellectual property rights, rights of publicity or privacy, or result in the violation of any applicable law or regulation.”

  1. AI-GENERATED CONTENT DISCLAIMER

The Service provides personalized greeting cards generated by artificial intelligence (AI) based on inputs provided by you, the user. While we strive for accuracy and relevance in the content generated by our AI, FromFido does not guarantee that the AI-generated content will always meet your expectations or be free from errors. By using the Service, you acknowledge and agree that FromFido shall not be liable for any direct, indirect, incidental, special, consequential, or exemplary damages, including but not limited to damages for loss of profits, goodwill, use, data or other intangible losses (even if FromFido has been advised of the possibility of such damages), resulting from: (i) the use or the inability to use the AI-generated content; (ii) the interpretation or misinterpretation of the AI-generated content; (iii) the cost of procurement of substitute goods and services resulting from any goods, data, information or services purchased or obtained or messages received or transactions entered into through or from the Service; (iv) unauthorized access to or alteration of your transmissions or data; (v) statements or conduct of any third party on the Service; or (vi) any other matter relating to the Service. You further agree that the total liability of FromFido under any circumstances shall be limited to the amount you have paid FromFido for the use of the Service, and in no case will it exceed this amount. You are responsible for the final review and approval of the AI-generated content before it is finalized and acknowledge that you bear the risk of any errors or unintended messages in the AI-generated content.

  1. PAYMENTS AND BILLING

The price of the product (which includes VAT) will be indicated on the order pages when you place your order.

You can pay for products using various payment methods as indicated during the checkout process.

9.1 Dispatch and delivery

The dispatch date is the date we send the item, not the date it is delivered. Delivery costs, if any, are notified at the checkout stage.

9.2 Refunds and Cancellations

Faulty products: If what you have bought is faulty or misdescribed you may have a legal right to end the contract or to get the product repaired or replaced or to get some or all your money back.

Change of mind: For most products bought online, you have a legal right to change your mind within 14 days and receive a refund, subject to certain conditions. Personalised products, including cards, are non-refundable.

While FromFido endeavors to ensure the accuracy and reliability of the services and the materials on our website and app, they are provided “as is” and “as available,” without warranty of any kind. We do not guarantee that our service will be free of faults, and we do not accept liability for any errors or omissions.
  • Service Interruptions. FromFido shall not be liable for any interruption to our services, including but not limited to computer or system failure, or any other cause that may prevent you from accessing our website or app. We make reasonable efforts to ensure that our service is available 24/7; however, we cannot guarantee that our website or services will always be available without disruptions.
  • Cap on Liability. To the fullest extent permitted by law, FromFido’s total liability for any claims under these terms, including for any implied warranties, is limited to the amount you paid us to use the applicable service(s) during the last 12 months.
  • Exclusion of Certain Damages. FromFido shall not be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from: (i) your access to, use of, or inability to access or use our services; (ii) any conduct or content of any third party using our services, including without limitation, any defamatory, offensive, or illegal conduct; or (iii) unauthorized access, use, or alteration of your transmissions or content.
  • Personal Injury. Notwithstanding the above, we do not exclude or limit our liability for death or personal injury resulting from our negligence, nor any other liability that cannot be excluded or limited by English law.

  1. INTELLECTUAL PROPERTY RIGHTS

Intellectual Property Rights and Copyright Protection: FromFido respects the intellectual property rights of others and expects its users to do the same. The Service utilizes artificial intelligence to generate content based on user inputs. FromFido does not claim ownership of the content originally created by users but requires a license to use such content as detailed in the User-Generated Content License section. FromFido makes reasonable efforts to ensure that AI-generated content does not infringe upon any third party’s intellectual property rights and adheres to copyright laws. However, FromFido is not liable for any inadvertent infringement of copyright or other intellectual property rights of third parties in the content generated by our AI. Users are responsible for ensuring that their input into the AI does not violate third party copyrights and that they have all necessary rights or permissions for the content they provide for AI-generated content creation. In the event of any claim of copyright infringement, FromFido commits to taking appropriate steps as per applicable copyright laws and our Copyright Policy to address the concern. Users aggrieved by any content generated through the Service may contact FromFido to have the content reviewed in accordance with our Copyright Policy.
